Opening Defense statement?

I have to write an opening defense statement for my mock trial team. I am defending sum1 who ran into a pedestrian with their car going about 6 mph..and he quickly glanced at his phone but didn't touch it while driving. the person crossing the road, though, was not crossing at a marked crossroad and he was texting. how do i write an opening defense statement defending the driver?
